2.2 Data processing is primarily carried out in accordance with the Swiss Federal Act on Data Protection (FADP). Where customers from the European Union or the United Kingdom are concerned, we also take into account the requirements of the General Data Protection Regulation (Regulation (EU) 2016\/679, GDPR).<\/p>\n

3. Hosting<\/h2>\n

This website is hosted by a provider based in Switzerland (Infomaniak Network SA, Geneva, Switzerland). When you access the website, the hosting provider automatically collects technical data and stores it in server log files (including IP address, date and time of access, page accessed, and browser used). This data is used for the technical provision and security of the website and is automatically deleted after a short period of time, unless there is a legal obligation to retain it.<\/p>\n

4. Order processing (WooCommerce)<\/h2>\n

4.1 The online shop is operated using the WordPress extension WooCommerce. To process an order, we collect the following data: name, billing address and shipping address, email address, telephone number (if provided), ordered items, and order and payment details.<\/p>\n

4.2 This data will be processed and stored exclusively for the purpose of fulfilling the purchase contract and complying with legal retention obligations.<\/p>\n

5. Customer account<\/h2>\n

5.1 Customers can optionally create a customer account ("My Account"). In addition to the order data, a username and an encrypted password will be saved.<\/p>\n

5.2 A customer account can be deleted at any time by contacting us, provided that there are no legal retention obligations to the contrary.<\/p>\n

6. Payment processing (Stripe)<\/h2>\n

6.1 Payments are processed via the payment service provider Stripe. The provider is Stripe, Inc., based in the USA, and its European subsidiary Stripe Payments Europe, Ltd.<\/p>\n

6.2 As part of the payment processing, the data required for payment (including name, payment information, and order amount) will be transmitted to Stripe. Further information can be found in Stripe's privacy policy at https:\/\/stripe.com\/de\/privacy.<\/p>\n

6.3 Since Stripe partially transfers data to the USA, this is done on the basis of suitable safeguards, in particular standard contractual clauses of the European Commission or recognized transfer bases under Swiss data protection law.<\/p>\n

7. Shipping<\/h2>\n

For the purpose of delivering the goods and tracking the shipment, we transmit the necessary address data (name, delivery address) to the respective transport company commissioned. Depending on the destination country, this may be a service provider based in Switzerland or within the European Union.<\/p>\n

8.1 This website uses technically necessary cookies, including those for the shopping cart and for logging into the customer account (session cookies and login cookies). 9. Google Tag Manager<\/h2>\n

9.1 This website uses Google Tag Manager, a service provided by Google Ireland Limited. Google Tag Manager itself is a tool for managing website tags and does not set its own cookies. However, when the Google Tag Manager container loads, the visitor's IP address is transmitted to Google servers, which may be located outside of Switzerland and the European Union.<\/p>\n

9.2 Currently, no other analytics or marketing tools (such as Google Analytics) are integrated via Google Tag Manager. Should this change, this privacy policy will be updated accordingly.<\/p>\n

10th Newsletter<\/h2>\n

tribal.art does not send its own newsletter. However, this website offers the option to subscribe to the Hammer Auctions newsletter. The email address entered during registration will be transmitted to Hammer Auctions for this purpose. Hammer Auctions is an independent company and is solely responsible for sending and further data processing in connection with this newsletter. The Hammer Auctions privacy policy at https:\/\/hammerauktionen.ch applies.<\/p>\n

When contacting us via email or a contact form, the data provided by the customer (including name, email address, content of the message) will be used and stored exclusively for processing the request, as long as this is necessary to answer the request and to fulfill any retention obligations.<\/p>\n

Personal data is stored only as long as necessary for the stated purposes or as required by law. Order and invoice data is subject to a ten-year retention period under commercial and tax law.<\/p>\n

Data subjects may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC). Where the General Data Protection Regulation (GDPR) is applicable, there is also a right to lodge a complaint with the competent supervisory authority in the respective country of residence.<\/p>\n
